Google Colab Additional Terms of Service

Last Modified: May 14, 2024 (view previous version of these terms)

To use Google Colab (“Colab”) and any Colab subscription or pay-as-you-go offerings (“Paid Services”), you must accept (1) the Google Terms of Service, and (2) these Google Colab Additional Terms of Service (the “Additional Terms”). Terms that are not defined in these Additional Terms have the meanings given to them in the Google Terms of Service.

Please read these documents carefully. Together, these documents are known as the “Terms”. They establish what you can expect from us as you use our services, and what we expect from you.

We also encourage you to read our Privacy Policy (and, in connection with any Paid Services purchased directly through Colab, the Google Payments Privacy Notice) to better understand how you can update, manage, export, and delete your information.

Using Colab

Our FAQ contains general information about Colab, including restricted activities, resource limits and supported browsers. You agree to those policies and usage limitations.

In addition, you may not:

Colab’s generative code features are still experimental and you’re responsible for your use of suggested code or coding explanations. Use discretion and carefully test and review all code for errors, bugs, and vulnerabilities before relying on it. You’re responsible for complying with any license requirements, including citations to open source code repositories.

Connected Services and Content

Colab lets you access and interact with other services, software libraries, APIs, and content, including some provided by third parties. These offerings are subject to applicable terms and licenses, as described in the “Other content” section of the Google Terms of Service.

You’re solely responsible for ensuring you have the necessary rights to connect to and use third-party offerings and for complying with any applicable terms.

Google does not operate, support, endorse, monitor, control, or assume any responsibility or liability for third-party offerings. Google is not responsible for the conduct of those third parties, including their security or privacy practices, and you should use discretion before using third-party offerings.

Paid Services

When you purchase Paid Services through Google Workspace, the preamble, Section 2 (Payment Terms), and Section 15 (Miscellaneous) of the Google Workspace Terms of Service govern payments, invoicing, billing, payment disputes, and related issues, while these Additional Terms and the Google Terms of Service govern your use of Colab and the Paid Services.

When you purchase Paid Services directly through Colab, the following terms apply:

Direct Purchases

The Paid Services include premium subscriptions or pay-as-you-go offerings as detailed on the Colab Pricing page.

To purchase a Paid Service, you must have a Google Payments account and agree to the Google Payments Terms of Service. You’re responsible for all charges associated with purchases made on your Google Payments account.

Managing Subscriptions

You can manage your subscriptions as part of Paid Services in a number of different places, including in the Google payments center. Please see this Help Center article for more information.

Price Changes

When you purchase a subscription, you’ll be charged at the price listed at the time of purchase. If the price later increases, we’ll notify you in advance by email. If you’re given at least 30 days’ notice, the increase will apply to the next payment due from you after the notice. If you’re given less than 30 days’ notice, the price increase will not apply until the following renewal.

If you don’t want to pay the increased price for a subscription, you may cancel the subscription before the increase takes effect as described in the “Managing Subscriptions” section above.

Taxes

“Taxes” means any duties, customs fees, levies, or taxes (other than income tax) associated with the sale of the Paid Services, including any related penalties or interest. You’re responsible for the payment of all Taxes, and must pay for the Paid Services without any reduction for Taxes. The price of Paid Services includes value added tax, as applicable. You must comply with all applicable tax laws, including those related to the reporting and payment of any Taxes, arising in connection with your use of the Paid Services.

Consumer Right of Withdrawal (EEA, Brazil, Israel, South Korea, and Türkiye)

Right of Withdrawal

If you’re purchasing Paid Services as a consumer based in the EEA, Brazil, Israel, South Korea, or Türkiye, then applicable law gives you the right to withdraw from this contract within 14 days (for South Korea, 7 days) without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract (for South Korea, 7 days from the conclusion of the contract).

To exercise the right of withdrawal, you must inform us (Google Commerce Limited, c/o Customer Support, Gordon House, Barrow Street, Dublin 4, Ireland, or via phone or email) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you are a consumer based in Brazil, you may also exercise the right of withdrawal using our support channels. If you are a consumer based in Israel, in addition to your right of withdrawal, you may also terminate your recurring subscription for Paid Services on 3 days’ prior notice to us via registered post or e-mail.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of Paid Services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

If you are a consumer based in Israel, your withdrawal may be subject to a fee equal to the lower of (1) 5% of the transaction fee, or (2) NIS 100. In addition, if you terminate your recurring subscription on 3 days’ prior notice as a consumer based in Israel, we’ll reimburse you for the proportionate amount collected for the Paid Services following the termination date.
